Petition Filed Against Alleged Illegal Detention of Javed Saeed
RAWALPINDI: The family of retired Air Marshal Javed Saeed, who was taken into custody from his residence in early 2024, has officially challenged his arrest and detention in the Islamabad High Court (IHC), demanding his safe release.
The petition, submitted under Article 199 of the Constitution of Pakistan, was filed by his wife, Shazia Javed, naming the federal government and the Pakistan Air Force (PAF) as respondents.
Allegations of Unlawful Detention
According to the petitioner, her husband's forced disappearance and continued detention violate fundamental human rights, as guaranteed by the Constitution of Pakistan and international human rights conventions, to which Pakistan is a signatory.
The legal appeal was filed by Advocate Inam-ur-Rehman, who stated that Air Marshal Javed Saeed retired on March 18, 2021, after an honorable career in the PAF. However, on January 1, 2024, he was allegedly abducted from his residence in Sector E-9, Islamabad, by government personnel.
Despite multiple attempts to seek clarification from police and PAF officials, the family received no immediate answers. It was only after several weeks that Shazia Javed was permitted to meet her husband.
PAF’s Involvement and Ongoing Inquiry
During the supervised meeting, an intelligence officer reportedly informed the family that PAF had detained the retired officer, and his inquiry was nearing completion, with expectations of his release in a few days. However, more than a year has passed, and no legal proceedings have been initiated.
Pension Stopped, Medical Entitlements Revoked
The petitioner also highlighted that Javed Saeed’s pension was suspended without justification, and his wife’s medical entitlements as a spouse of a retired PAF officer were also revoked. After persistent protests, she was only allowed limited medical treatment at PAF Hospital E-9, Islamabad.
Despite repeated attempts to communicate with senior PAF officials and seek legal clarification, the illegal detention of Air Marshal Javed Saeed continues without any formal charges or trial.
Legal Demands for Due Process
The petition demands that if any charges exist against the retired officer, they should be presented before a competent court following due legal process.
The case raises critical concerns about human rights, transparency in military detentions, and legal protections for retired armed forces personnel in Pakistan. The Islamabad High Court is now expected to review the case and decide on the next legal course of action.
